UK Regulator Sets Terms for Early Car Finance Settlement Offers

The FCA says lenders may offer car finance compensation before legal challenges to its scheme end, provided customers get no less than the scheme would pay.

What happened

On Tuesday the FCA spelled out its terms for lenders wishing to settle early with borrowers due redress over car loans, while court cases over its scheme continue [1]. It welcomes such deals provided nobody ends up with less than the scheme would deliver [1]. Barclays Partner Finance says it intends to put offers to a portion of the borrowers it owes [1].

Alongside the guidance came polling in which 89% of people who had lodged, or were weighing, a complaint said they want the choice of a compensation offer now rather than waiting for the legal challenges to end [1]. Of those polled, 86% felt at ease choosing, 61% would take a scheme-equivalent sum, and 77% said quicker money would matter to their household budget [1].

How it affects Americans

The scheme covers UK motor finance customers, and the release does not address US borrowers or lenders [1]. Our read: American auto lenders and investors with UK exposure may watch how voluntary settlements work as a way to resolve mass redress while litigation is pending. Lenders planning offers should tell the FCA, which will keep an updated online list so people can check that an approach is genuine [1].

The Veil Press view

Stephen Braviner Roman, the FCA's general counsel and co-lead on the motor finance project, said: "Fair settlement offers could result in some people getting money sooner." [1] Our read: an early offer trades certainty for the chance of a larger payout, so clear disclosure matters. Anyone who says yes holds on to the cash even if the court process would have paid less, yet loses any right to top it up should a bigger one emerge [1].

What we know

Confirmed

  • Payouts were meant to begin this year; the programme now sits partly paused, with court hearings slated for 16 February to 3 March 2027 [1].
  • In the pause, lenders still ready themselves and move complaints along, though working out and paying sums can wait for the litigation to finish [1].
  • Because people may turn an offer down and stay in the scheme, the Financial Ombudsman Service will not review these offers [1].
  • Any lender approaching customers has to hand over an FCA factsheet [1].
  • Kantar polled 1,000 borrowers online from 25 to 28 June 2026; the headline results draw on 590 of them who had complained or might [1].
  • Complaining straight to a lender costs nothing, while paid representatives can take up to 36% of a payout, VAT included [1].

Still being reported

  • The FCA expects only some lenders to take part, possibly for just part of their customer base [1].
  • Barclays Partner Finance is the only lender the release names as planning offers [1].
