Britain Ends Near-Automatic Settlement After Five Years for Migrants

Under a new earned settlement model, the wait for permanent residence in the UK will range from 3 years for top earners to at least 20 years for rule breakers.

What happened

Britain's government told Parliament on Monday that migrants will no longer receive the right to live in the UK permanently almost automatically after 5 years [1]. Under what it calls an earned settlement model, the wait will hinge on each person's contribution and character [1].

The highest earners could settle within 3 years, while people earning more than £50,271 and some public service workers, such as doctors, nurses and teachers, keep a 5-year route [1]. For most others the standard wait becomes 10 years, and anyone who broke immigration rules faces at least 20 years [1].

How it affects Americans

The announcement does not mention Americans. Our read: U.S. citizens working in Britain on visas would fall under the same rules as other migrants, so lower-paid American workers there could face a 10-year wait instead of 5. The government says those earning more than £50,271 keep a 5-year path, and family members of British citizens will keep their current pathways [1].

The Veil Press view

Tying permanent residence to earnings, a clean record and tax contributions is a clear rule, and ministers promise that nobody who already has settled status will lose it [1]. Applying the new tests to people already in the country, rather than only new arrivals, is the more contested choice, and Home Secretary Shabana Mahmood defended it in Parliament on the basis that settlement rules are set when a decision is made [2].

What we know

Confirmed

  • All applicants face 4 conditions the government calls non-negotiable, regardless of arrival date [1].
  • They cover a clean criminal record, strong spoken English, owing nothing to the taxpayer and steady National Insurance payments [1].
  • The language test is pegged to A-Level English as a foreign language [1].
  • Care staff who kept to their visa terms and were paid £25,000 a year or more keep a 5-year route [1].
  • Around a quarter of care workers do not qualify and will be offered a second chance through a new 5-year visa [1].
  • Officials say 1,800 exploitative employers can no longer sponsor overseas staff [1].
  • Apart from the arrangements for care workers and for public service workers in healthcare and education who arrived during the same period, the government says settlement rules continue to apply at the point of application [1].

Still being reported

  • Officials put the number facing a wait beyond 5 years at over 500,000 [1].
